PA case challenges lack of right to counsel in fees/fines cases

Commonwealth v. Diaz, a case pending in the Pennslvania Superior Court, involves a defendant who was incarcerated for failure to pay criminal fees/fines without a proper inquiry into whether he could pay.  The NCCRC's amicus brief argues that there is a national consensus as to providing counsel prior to incarceration regardless of whether the proceeding is criminal or civil.
