SF3504: Though titled only “Parentage Act” (as opposed to “Uniform Parentage Act”), the bill has the same impact on the RTC as HF 3567; providing that “[t]he court shall appoint an attorney, guardian ad litem, or similar person” for a minor child in a proceeding under the chapter “if the court finds that the interests of the child are not adequately represented.” as to a minor child in a proceeding under the chapter, the bill provides “[t]he court shall appoint an attorney, guardian ad litem, or similar person” “if the court finds that the interests of the child are not adequately represented.” However, the bill would repeal Minn. Stat. § 257.69, the statute that provides a right to counsel to indigent petitioners and respondents in such matters. Presumably, the right to counsel provided to petitioners and respondents under court rule would still apply. See Minn. Gen. R. Prac. 357.03 (requiring child support magistrate to appoint attorney at public expense for indigent party that requests attorney in all cases of establishment of parentage).
