SB0485: Under current law, children in abuse/TPR matters are entitled to an attorney GAL, and indigent parents are entitled to counsel in such matters. This bill would specifically address the issue of counsel for Indian children and their parents or custodians in matters related to removal, placement, and termination — providing for the discretionary appointment of counsel for Indian children upon a finding that the appointment is in the child’s best interest, as well as providing counsel to indigent parents and custodians of Indian children. Requires other certain procedures mirrored in the federal Indian Child Welfare Act as well.
