A01086: In residential eviction matters where the respondent fails to appear, the petitioner must file an affidavit attesting to whether the respondent is a ‘senior citizen’ (defined as anyone 62 yrs of age or older or anyone who resides with a spouse of this age). If either (i) the respondent is a senior citizen or (ii) the petitioner is uncertain as to whether the respondent is a senior, the court cannot enter a final judgment or order without first appointing an attorney to represent the respondent and the respondent’s interests. Also, generally permits appointment of counsel for senior citizens in such cases if they are either unrepresented or fail to appear.
