A06398: Similar to SB 3991. Would create “civil right to counsel program” and state agency to oversee it. Cases referred to agency evaluated for case complexity, whether other side is represented, adversarial nature of proceeding, and a host of other factors. Also would require counsel for indigent person “charged with an offense punishable by a revocation or suspension of such person’s drivers’ license where the person is dependent on driving for their employment or where there is a lack of public transportation in the person’s surrounding area.”
