AB344: Currently, the court may appoint counsel for a parent respondent in abuse matters. The bill would expand discretionary appointment, by permitting the court to appoint counsel for any parent, regardless of whether the parent is a respondent. Further, it would mandate appointment of counsel for parent respondents who are indigent as soon as a child is taken into custody “unless good cause is shown for not appointing an attorney to represent the parent or other person.” The provision goes on to specify that “good cause” includes the failure to communicate with previously appointed counsel; harmful or offensive conduct; requesting new counsel without valid justification; and a high likelihood that the appointment of counsel will cause undue delay.
