Discretionary appointment
MD Rules, Rule 10-601(a) provides, “A fiduciary or interested person may file a petition requesting a court to assume jurisdiction over the fiduciary estate for the purpose of determining its distribution if the petitioner believes that there may be a person whose identity or present whereabouts is unknown who is entitled to share in the estate.” In such matters, “[t]he court may appoint an attorney to protect the interest of a person whose identity or whereabouts is unknown.” MD Rules, Rule 10-604.
