H0742: Creating a right to counsel for individuals subject to removal proceedings and domiciliaries of Vermont or being held in Vermont-based detention center. Creates Legal Representation in Federal Immigration Proceedings Program within the Office of Defender General in Vermont. A covered individual is entitled to be represented by an “attorney to the same extent as a person having the person’s own counsel, including for purposes of any appeal; and to be provided with the necessary services and facilities of representation.” Costs are at public expense if the person is unable to provide payment. Legal representation would begin no later than detention facility’s intake process.
