HB1291: Same as SB 1530: Creates procedure requiring a child’s guardian ad litem, attorney, Court Appointed Special Advocate (“CASA”), and others to notify the court if they become aware that a child in foster care has suffered an injury that may constitute a tort. Provides that the court shall hold a hearing to determine whether to appoint a master to investigate the merits of a tort claim. If the court decides further action is necessary, it may issue an order authorizing the tort claim and either appoint outside counsel for the child if this is in the child’s best interest or authorize master to continue to represent child.
