HB2223: This bill would prohibit the levying of attorneys’ fees against indigent criminal defendants represented by the public defender. It states in pertinent part, “No person who is found indigent pursuant to this section shall have fees assessed against him for any amount paid by the Commonwealth for legal representation.” The amount of fees levied against an individual for costs such as attorneys’ fees can have profound implications on whether that person is later found in default of legal financial obligations (LFOs) and therefore subject to a civil enforcement matter, for which willful nonpayment can result in incarceration and during which the person may not have the right to counsel.
