HB4966: Children in abuse cases are entitled to representation, but that representation may be fulfilled either by (i) a GAL who is a licensed attorney or (ii) a CASA where the CASA is represented by an attorney. This is true unless there’s a conflict between the minor’s interests and what the GAL determines to be in the minor’s best interest, in which case a separate attorney must be appointed for the child. HB 4966 would create a right to appointed counsel for a subset of children in abuse cases — youth in care with special needs. The bill states, “Unless a youth is already represented by an attorney in these proceedings, an attorney shall be appointed for a youth in accordance with subsection (e) or (f) of Section 7.30 of the Children and Family Services Act.”
