LR170: In Nebraska, truancy is treated as a status offense, pursuant to Neb. Stat. §§ 43-245(25) and 43-247(3), and children have a right to appointed counsel regardless of indigence in such proceedings under Neb. Rev. Stat. § 43-272(1). This resolution would propose an interim study to examine children’s access to legal counsel in juvenile proceedings in Nebraska, examining information including “[a] review of national policies, recommendations, and best practices for ensuring meaningful access to legal counsel for juveniles in both urban and rural environments.”
