In 2021, New Jersey, relying on a mix of different federal funds, launched an eviction right to counsel pilot project in Mercer County, Essex County, and Atlantic County that will provide counsel to all tenants facing eviction in those counties.  That same year,AB 5664 was introduced, which would have required appointment of counsel for tenants facing eviction who are at or below 80% of area median income.

In 2025, Stout released a cost/benefit analysis for a statewide tenant right to counsel, finding an estimated return of $2.30 to $3.14 for every dollar invested, which translates to savings of $200-272.6 million with an $86.8 million investment.
