If an adult in need of protective services requests the services or consents to receipt of the services, the services shall be offered. See 35 Pa. Stat. Ann. § 10225.304. But services may also be provided on an involuntary basis through court order. 35 Pa. Stat. Ann. § 10225.307(c) provides that in petitions for emergency adult protective services on an involuntary basis, “In order to protect the rights of an older adult for whom protective services are being ordered, an emergency court order under this section shall provide that the older adult has the right to legal counsel. If the older adult is unable to provide for counsel, such counsel shall be appointed by the court.”
