SB2277: Currently, in a private TPR matter, the court must appoint either a best interests attorney or an attorney ad litem for a child unless child’s interests are adequately represented by a party to the suit without a conflict. Bill would remove best interests attorney, making attorney ad litem mandatory, while permitting appointment of best interests attorney if necessary at the parties’ expense, taking into consideration factors including parties’ ability to pay.
