SB136: This bill would repeal the “Uniform Guardianship and Protective Proceedings Act” and replace it with the “Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act”, drafted by the uniform law commission. Renumbering right to counsel (RTC) provision for adults in guardianship establishment matters and applying same factors to appointment of counsel for adults subject to conservatorship proceedings; providing RTC to adults subject to emergency guardianship petitions; and RTC to individuals subject to a conservatorship who seek to remove the conservator and appoint a successor, as well as to those who seek to terminate or modify conservatorship.

Would provide RTC for parents of children subject to conservatorship proceedings if a parent objects to appointment, the court determines counsel is needed to ensure that consent to appointment is informed, or the court determines that respondent needs representation; would require counsel for minors subject to guardianship petitions if (a) requested by the minor and minor is 12 years of age or older, (b) recommended by a GAL; or (c) if the court determines the minor needs representation.
