SB411: Codifying recent Hawaii Supreme Court decisions to require the court to appoint counsel for indigent “legal parents” upon the filing of petition for custody or family supervision. Counsel must be provided at the first hearing the parent attends, unless the right to counsel is knowingly and voluntary waived. Places an affirmative duty on the court to inquire about parent’s indigence if they appear without counsel. Prohibits entry of a finding or an order that is prejudicial to the parent if the parent’s attorney is not present. Finally, the court must provide a continuance upon request if counsel is not appointed at least 3 days before the hearing. This bill is the same as HB 829 and HB 779.
