HF5237: Indian children 10 yrs of age or older already have the RTC in any “state court child placement proceeding.” The bill would add discretionary appointment for children younger than 10 if the court determines that appointment is appropriate and in child’s best interest. Also clarifies that appointment of counsel should occur prior to the first hearing and extends to “all stages of the proceeding” and clarifies that “state court child placement proceedings” include temporary and permanent removal of an Indian child from their parent or custodian
