Forfeiture right to counsel bills have died
In 2023, Tennessee introduced cross-filed bills (HB 1285 / SB 1462) that would have provided a right to counsel for certain defendants in civil asset forfeiture matters. Specifically, if a criminal defendant represented by appointed counsel in the criminal matter were a claimant in a related forfeiture matter, then the defendant would be entitled to appointed counsel for the forfeiture proceeding.
The NCCRC submitted testimony in support of HB 1285 to the House Subcommittee on Criminal Justice. Though the bills carried over to 2024, both have died — SB 1462 in Committee and HB 1285 in Chamber.
