WA considers pre-petition RTC for parents in abuse cases

In 2024, the Washington House of Representatives introduced HB 1295 to provide a pre-petition right to counsel for parents in abuse matters.  Specifically, if prior to the filing of a dependency case, the Department of Children, Youth, and Families proposes a ‘voluntary’ placement agreement, the child’s parent, guardian or legal custodian would have the right to consult with an attorney by telephone or video conference.  If after the consultation, the parent desires to have an attorney assigned, they shall receive representation by counsel according to the implementation schedule outlined in the bill.

Public hearing on the bill was held in the House Committee on Human Services, Youth, & Early Learning.  The bill was then referred to the House Appropriations Committee where it died.
