SB539: Same as HB4604. Modifies child and parent RTC provisions in §49-4-601(f). Separates parent and child right to counsel. Modifies child RTC provision to state that a child “may be” represented by legal counsel, GAL, or both and that the court shall appoint legal counsel, GAL or both. Adds definition of Guardian Ad Litem to §49-1-201. To define GAL as an attorney appointed by the court. Adds §49-4-601(f)(7) which would allow for the discretionary appointment of assistant GAL to assist GAL. Updates compensation and reporting requirements for GALs and appointed attorneys. Adds findings court has to enter at the end of any hearing related to whether appointed guardian ad litem and attorney complied with various specified rules and obligations (ex: §49-4-608(m) and §49-4-610(9)(C)).
