Hawaii bill aims to ensure immigrants have access to their retained counsel

In 2026, the Hawai’i state legislature enacted HB 1839, a bill aiming to ensure immigrants have access to their retained counsel. It addresses due process considerations prior to and during civil immigration interviews, including an opportunity to consult with counsel (See Sec. 353-C(c), which provides, “Upon request, a law enforcement agency shall provide reasonable phone access and a reasonable opportunity to consult with counsel before any civil immigration interview.”)
