HB5026: Enacting a new code section, §49-4-112a, found within the Chapter covering Domestic Relations and the Article covering Adoption matters, titled “Adoption and Legal Guardianship Proceedings Related to Abuse and Neglect Cases”, which provides that in an adoption or legal guardianship case originating as a result of an approved permanency plan in a juvenile abuse and neglect proceeding, prospective adoptive parents or legal guardians must file a motion requesting appointed counsel. Within five judicial days, the court shall appoint an attorney to represent them, drawing from the circuit court’s list of panel attorneys utilized for appointment in certain case types including juvenile abuse and neglect, delinquency, juvenile status offenses, and juvenile guardian ad litem appointments.
