Kentucky eliminates ability of the PD to represent those held in civil contempt

In 2026, the Kentucky legislature enacted HB 762, which unfortunately prohibits the Department of Public Advocacy (the public defender) from representing individuals being held in civil contempt for the inability to pay child support. Although such individuals have a right to counsel under both statute and potentially, under case law, it is now unclear who would provide the representation.
