HF4106: Minnesota already provides for a process through which a guardian may be appointed for an adult on an emergency basis as well as a right to counsel in such matters. The existing law specifies that a petition for appointment of an emergency guardian is appropriate where “compliance with the procedures of this article will likely result in substantial harm to the respondent’s health, safety, or welfare.” The bill would have created a new basis for emergency appointment designed for situations where “the court finds that at the time of the petition the respondent is awaiting release from a hospital emergency department or discharge from an acute care hospital because the hospital cannot identify a safe location to release or discharge the respondent without the respondent having coverage under medical assistance.” The new provision would have extended the respondent’s right to counsel to such matters. These provisions were removed through an amendment, however.
