LB1168: Providing that there is a rebuttable presumption that an individual has the capacity to make or revoke a health-care decision, health-care instruction, and power of attorney for health care. The presumption may be rebutted through a finding by the court. The bill would provide the right to counsel to individuals in matters related to determinations as to their mental capacity. Specifically, the bill provides, “The court in which a petition under subsection (a) of this section is filed shall appoint legal counsel to represent the individual if the individual does not have legal counsel.”
