S3740: This bill seeks to reinstate the requirement that minors notify their parents of their intent to seek an abortion. In proceedings to bypass the requirement, minors have the right to counsel upon request. However, in 2000, the New Jersey Supreme Court held that law was unconstitutional under the state’s equal protection clause, since it required minors seeking an abortion to notify their parents but did not impose the same requirement on minors seeking medical or surgical care related to their pregnancies without adequate justification for the distinction. See Planned Parenthood of Central New Jersey v. Farmer, 762 A.2d 620 (N.J. 2000). Thus, this law would require minors to notify their parents of their intent to seek “any medical or surgical procedure or treatment.”
