Bill would have provided right to counsel for guardianship termination and modification
In 2024, the Kentucky Senate introduced SB 53, which would have established a right to counsel upon request for protected persons seeking termination or modification of their guardianship/conservatorship or removal or replacement of their full or partial guardians or conservators. The bill also specified that an appointed attorney for a proposed protected person serves in a client-directed role, as opposed to a best interest or guardian ad litem capacity. The bill died in the Senate Judiciary Committee.
Under the current law, there is ambiguity as to whether an individual is entitled to appointed counsel for termination and modification matters. See Kentucky , Legislation , Guardianship/Conservatorship of Adults – Protected Person to learn more.
