Legislation: timing of appointed counsel for parents
02/21/2017, Legislation, Abuse/Neglect/Dependency - Accused Parents
SB 1061 would have clarified the Hawaii Supreme Court's ruling in In re T.M., which established a right to counsel for parents in abuse/neglect proceedings but left it unclear as to whether counsel is appointed before after the petition is initially filed, by specifying that counsel is appointed immediately after the petition is filed. But it died in the JDL and WAM committees.
