Right to counsel
While a state may have many statutes, court decisions, or court rules governing
appointment of counsel for a particular subject area, a "Key Development" is a
statute/decision/rule that prevails over the others (example: a state high court
decision finding a categorical right to counsel in guardianships cases takes
precedence over a statute saying appointment in guardianship cases is
discretionary).
Legislation, Sexually Dangerous Persons - Commitment
There is a right to counsel for indigent respondents in sexually violent predator commitment cases, including for review of the commitment. Cal. Welf. & Inst. Code § 6603(a), 6605(a)(3).
In People v. Hill, 162 Cal. Rptr. 3d 3 (Cal. App. 2013), the Court of Appeals concluded that there is a right to effective assistance of counsel in sexually violent predator proceedings.
